被笑智障怒殺人 男子判13年

何姓男子不滿美髮店于姓老闆娘看到他的身心障礙手冊笑他「智障」，憤而持尖嘴鐵鎚猛鑿于婦頭部20多下斃命，逞凶後偷走于婦2台筆電與現金300元逃離。新北地院昨天依殺人罪判何徒刑13年，竊盜部分判刑5月，得易科罰金。于婦家屬求償320萬元，移由民事庭審理。

法院調查，42歲大陸籍于姓婦人嫁來台灣4年，在新北市新莊區四維市場附近經營美髮店，去年10月26日，被美髮店隔壁的修鞋店夫婦發現陳屍店內，頭部遭重創。警方調閱案發現場周邊監視器畫面及比對現場指紋等跡證，查出于婦的常客何姓男子涉有重嫌，隨即逮捕他。

何落網供稱，他有精神疾病並領有身心障礙手冊，案發前幾天他到美髮店消費，從皮夾拿出錢時，殘障手冊掉出，于婦看到後笑他「智障」，他嚥不下這口氣才起殺機。他說很後悔一時衝動做傻事，也向于婦家屬道歉並希望和解，但未獲接受。

法官囑託醫院精神鑑定，認定何犯罪時並無喪失辨識行為違法的能力，並未因此減刑。
