騎士跌水溝溺死 獲國賠83萬

彰化縣民黃清金3年前晚上騎機車跌入大排水溝溺死，家屬請求國家賠償，最高法院認為現場沒有警告或夜間照明、反光標誌，顯有管理缺失，昨天判決彰化縣府賠償家屬共83萬多元定讞。

黃清金2010年1月10日晚上，騎機車經過二林鎮源成排水溝防汛道路，不慎跌入道路末端的排水溝裡溺死，家屬認為，案發地點未設置警告標誌或方向指引標誌，且路旁護欄設置不當、沒有照明設施，才造成悲劇，求償325萬元。

縣政府辯稱，防汛道路專供防汛、搶險運輸使用，並非公眾使用，且路口設有「禁止進入，違者自負其責」的警告標誌，相關營建法規也無明確的護欄設置規定，不同意國賠。

法院認為，防汛道路供車輛行駛多年，應視為一般道路，因道路末端就是排水溝，在缺乏夜間照明、反光標誌的情況下，車輛駕駛人有掉落前方排水溝的危險，但縣政府未設置警告及夜間照明或反光標誌，顯有管理過失。
