懲奸除惡棒打人 判9年10月

台南市鄭姓男子不滿李姓同事挑撥他和女友的感情導致分手，在木製球棒上寫「懲奸除惡專用」，到公司猛打李的頭部，李送醫後撿回一命。

最高法院依殺人未遂罪將鄭判刑9年10月，全案確定。

鄭姓男子和李姓男子同在台南市南區某工廠工作，鄭不滿李挑撥他和女友的感情，2012年7月間事先在一把木製球棒上寫「去你媽的李○○」、「懲奸除惡專用」，隔天到工廠看到李，不由分說就往對方頭部猛打4、5下。

李姓男子不支倒地，鄭拿起附近的白鐵製座椅企圖再往李的頭部砸；其他同事發現，上前阻擋鄭，李則被送往醫院急救後撿回一命。

鄭供稱，沒有殺人的意思，當時太緊張才會都往李的頭部砸。

法院調查，鄭曾稱拿球棒朝頭部攻擊會致人於死，卻仍朝李的頭部猛打，沒攻擊其他部位，棒棒都有致對方於死的故意，且李要掙扎起身時，鄭還打算拿椅子砸頭，殺人意圖明顯。
