元旦起 護理人員回歸正常工時

（中央社記者魏紜鈴台北30日電）勞委會日前公告，民國103年元旦起，醫療機構護理人員適用勞基法排除責任制，全面回歸正常工時。

長期以來護理人員超時工作，國內屢屢出現「血汗醫院」現象。行政院勞工委員會2年前便邀集相關機關及勞雇團體，檢討勞基法第84條之1責任制。並確定「醫療保健服務業」分階段回歸正常工時：除急診室、產房、手術室、麻醉恢復室、燒傷及中重度病房、加護病房、器官移植小組等緊急部門醫事及技術人員到民國103年元旦起排除責任制以外，其餘工作者在101年3月30日起，就已回歸勞基法一般工時規定。

換言之，103年元旦起，醫療機構護理人員便全面回歸法定工時，每天最多只能上8個小時的班，若要加班應給付加班費且一天不得工作超過12小時，遇緊急狀況不能超過14小時。出勤間隔應至少12小時；每月工時不超過240小時。

勞委會已訂定「 醫療保健服務業適用勞基法第84條之1之場所及人員工時審核參考指引」（醫療保健服務業工時參考指引），要求地方勞政主管機關依此審核依據，善盡責任嚴格審核，以維護護理人員勞動權益。1021230
